KohAI terms of use

These terms are the agreement between you and [LEGAL NAME], trading as VNP Media, [ADDRESS], the Netherlands, Chamber of Commerce number [KVK NUMBER] ("we", "us"). They cover the KohAI app, your KohAI account and trykohai.com. By installing KohAI or creating an account, you agree to them. Please read them; they are short.
1. What KohAI is, and what it is not
KohAI is a learning app. You chat with the AI coding tool you already use, and KohAI explains what it built, line by line, at your level, with lessons, practice and levels.
KohAI is not an AI. It does not write code or explanations itself. Everything the AI says comes from your own AI tool (Claude Code, Codex or Gemini CLI), which KohAI starts on your computer for you.
KohAI is not a school, a course with a certificate, or job training. It does not promise you a job, an income or a skill level by a date.
KohAI is independent. It is not made by, endorsed by or affiliated with Anthropic, OpenAI or Google.
2. Who can use KohAI
You must be at least 18 years old. You confirm this when you create an account. You must also be allowed to use the AI tool you connect under its own rules.
3. Your AI tool and its own terms
To use the AI parts of KohAI you need your own account with an AI tool, installed and signed in on your computer by you. You pay that company yourself, under your own plan.
- Your use of that tool is governed by its maker's terms and policies, not ours: Anthropic for Claude Code, OpenAI for Codex, Google for Gemini CLI. You are responsible for following them, including their age rules and usage limits.
- KohAI never sees, stores or passes on your login or API key. It only starts the program you installed.
- What you type, the code, and the files your AI tool reads go from that tool to its maker. We do not control what they do with it. Check their privacy settings, especially on free tiers, where your prompts may be used to improve their products.
- If an AI tool changes, stops working with KohAI, or limits your account, we are not responsible for that. We will try to keep KohAI working with it, but we cannot promise it.
4. Your code stays yours
Your code, your projects and what you write in practice are yours. We claim no rights in them. KohAI does not send them to us, so we do not receive them. Who owns code your AI tool writes, and on what terms, is between you and that tool's maker.
5. Your licence to use KohAI
We give you a personal, non exclusive, non transferable right to install and use KohAI on your own computers for your own learning and work, for as long as you follow these terms.
You may not:
- copy, sell, rent or share KohAI itself, its lessons, its avatar, or its other content, except as the law allows
- take KohAI apart or try to get its source code, except where the law or an open source licence gives you that right (for example to make it work with other software, or to replace the FFmpeg library KohAI uses under the LGPL)
- remove our notices or the open source notices
KohAI includes open source software. Those parts come under their own licences, listed in the third party notices. Nothing in these terms limits your rights under those licences.
6. Your account
You can use most of KohAI without an account. An account lets you keep your plan and buy gems.
- One account per person. Give a real email address and keep your password secret.
- You are responsible for what happens in your account, unless someone else got in through no fault of yours.
- You can delete your account at any time on trykohai.com/account. What happens to your data then is in the privacy notice.
7. Using KohAI properly
Do not use KohAI, your account or our website to:
- break the law, or someone else's rights
- break the terms of your AI tool, for example by trying to get around its limits or safety rules
- create malware, attack systems you do not own, or help someone else do that
- try to get into accounts, servers or data that are not yours, or overload or probe our service (including our account and gems servers)
- cheat the gems or purchase system, for example by changing KohAI's files to fake a balance or by using a stolen payment method
- create many accounts to get around limits, or sell or share your account
If you do, we may suspend or close your account. Unless it is urgent or the law stops us, we tell you first and give you a chance to explain.
8. Letting your AI change files and run commands
KohAI has modes that decide how much your AI tool may do without asking you:
- Ask me: you approve each change and command.
- Accept edits: changes to files inside your project go ahead without asking. Changes to the tools' own folders (such as
.gitand.claude) still ask. - Let it run: also commands that KohAI can read and that stay inside your project and reach no network. Anything else still asks.
- Plan first: your AI only reads and plans.
Please know the limits:
- KohAI can only check what your AI tool tells it. A program your AI writes and runs can do anything a program can do on your computer, including reaching the internet or deleting files. KohAI cannot stop that.
- Code written by AI can be wrong, unsafe or insecure, even when it looks fine and even when KohAI explains it. KohAI's explanations and grades also come from your AI tool and can be wrong.
- You decide what to run, keep and ship. Use Accept edits and Let it run only on projects you trust, keep backups (git helps), and review code before you rely on it or publish it.
9. Gems, chests and items
KohAI has a game layer to keep learning fun.
- Earned rewards. You earn XP, chests, gems, badges and some items by learning. A chest holds a random amount of gems and sometimes a rare item. Chests are only earned. They are never sold, and nothing random is ever sold for money.
- Bought gems [not on sale yet]. You can buy gems in fixed packs. A pack always gives exactly the number of gems shown, and the price is always shown with it. You must be 18 or older to buy.
- What gems are. Gems are a licence to use features inside KohAI, not money. They have no cash value outside the refund rules, cannot be exchanged for money or anything outside KohAI, cannot be sold or transferred, and earn no interest. Prices in the shop are shown in gems and, next to them, in money.
- What gems buy. Fixed items with a fixed price: looks for your avatar, themes, streak freezes and boosts. You always see what you get before you spend. A boost bought with bought gems never brings a chest sooner: XP from it does not count toward chests.
- Earned and bought gems. Earned gems are spent first; among bought gems the oldest are spent first.
- Bought gems are kept on your account on our server. Earned gems, chests and items live on your computer. If you delete your account, bought gems are gone. If you delete KohAI's folder on your computer, earned gems and items are gone. SAM: decide whether to restore bought items after a reinstall.
- Changes. We may change the shop, prices in gems and the items on offer. We will not take away an item you already own or gems you already have, except for a refund, a mistake we correct, or misuse under section 7.
- If KohAI ends. If we stop KohAI, we tell you at least [60] days before, stop selling gems at once, and [refund unspent bought gems / let you use them until the end]. LAWYER and SAM: decide.

10. Paid plans [later]
KohAI is free today. When paid plans start, these rules apply and the prices are shown before you pay:
- Plans are monthly or yearly. The price shown includes VAT (or consumption tax), as the law where you live requires.
- A monthly plan renews each month until you cancel. You can cancel at any time in your account, online, in a few clicks. The plan then runs to the end of the month you paid for.
- A yearly plan is paid once up front for 12 months. We email you 30 days before the year ends. If you do nothing, it does not renew for another year: it continues as a monthly plan at the monthly price, which you can cancel at any time, effective at the end of that month.
- Cancelling is online, in your account, with a "Cancel plan" button. In the EU and UK you can also withdraw within 14 days with the "Withdraw from contract here" button.
- If we change a price, we tell you at least [30] days before it applies to you, and you can cancel before then.
- Your right to withdraw and refunds are in the refund policy.
11. Our part of the deal
We work to keep KohAI useful, safe and available, and we fix faults we are told about. KohAI is a learning tool, built by a small team, and depends on AI tools we do not control. So we cannot promise that it is always available, free of errors, or right in every explanation.
If you are a consumer, you keep all your legal rights for digital content and services, including the right to have a faulty product fixed, and in the European Union the rights under the Digital Content Directive. Nothing in these terms takes those away.
12. Liability
- We are fully liable for damage we cause on purpose or through gross negligence, for death or injury, and wherever the law does not allow us to limit liability (for example under product liability law).
- Only for damage caused by ordinary (slight) negligence, and never for intent or gross negligence: we are liable only for foreseeable damage that comes from breaking an important duty under these terms, and our total liability is limited to the amount you paid us in the 12 months before the damage, or 50 euro if that is more. LAWYER: in Japan a cap must say plainly that it does not cover intent or gross negligence (Consumer Contract Act art. 8(3)); in the Netherlands a cap in consumer terms is presumed unreasonable (art. 6:237 sub f BW); in Germany only this "cardinal duty" form survives. Check per country.
- Your AI tool is made and run by another company. We do not control what it writes, does or charges you, so we are not responsible for that. If damage comes partly from a fault in KohAI itself, we are liable for our part under this section.
- Keeping backups is your part. If data is lost and a normal backup would have saved it, we are liable only for the cost of restoring it from that backup.
13. Ending
You can stop at any time: uninstall KohAI and, if you like, delete your account. We may end these terms or close your account for serious or repeated breaking of section 7, or if we stop KohAI, with notice as in section 9 where possible.
14. Changes to these terms
We may change these terms for good reasons, such as a new feature, a law or a security need. We tell account holders at least [30] days before important changes, by email or in the app. If you do not agree, you can stop and delete your account before the change applies; for a paid plan you can then cancel and get back what you paid for the time not yet used.
15. Law and disputes
Dutch law applies to these terms. If you are a consumer living in another country, you also keep the protection of the mandatory consumer law of that country, and you can go to court where you live.
